Can you get divorced from someone if they are in another state?   Another similar question to that is – can you get divorced from someone if you have no idea where they – and I will answer that question during next week’s Wednesday Divorce Wisdom – so make sure you tune in for that if that is a burning question you have.

But for today – the question I am answering is can you get divorced from someone if they live in another state:

So the short answer is yes – of course.   BUT there is a bit more to getting them served and getting what the law calls personal jurisdiction over that person.

You will have to put some special language into your complaint or petition – whatever your initial divorce pleading is called in your jurisdiction – that is called Long Arm Language.

It is called that because you are basically asking the local jurisdiction to reach out with a super long arm and pull that person back to your jurisdiction – and the reasons could be because that person has a lot of contacts with that state – meaning they do business there, they have real estate there –or maybe some other reason –

Then a special process server will have to be appointed in the place where your spouse lives – there is a bit of a process with that too.

But to answer the question – can you divorce someone who is out of state – the answer is YES!
